The Respondent here is the TPG Internet Pty Ltd ("TPG") which has been involved in the campaign regarding multimedia advertising. During the advertising campaign the company initially made an offer to the customers to give them an attractive price for the ADSL2+ service that they were providing. This service was primarily related to the use of the home telephone connection of the customer and likewise gives them a broadband service and also they promised to not charge for any download data limit. ( para 2) The advertiseme9nt board made a prominent display of the offer with more focus on the scheme of the company to provide an internet ADSL2+ service at the cost of $29.99 per month. (para 1) However, the advertisement in a more ambiguous and less prominent manner displayed that the offer was valid only when it is bundled with the home telephone connection for $30.00 per month that will be provided by TPG. (para 2) The offer further states that the customers are required to give a deposit of $20.00 for the telephone charges and pay setup fee of $129.95 This advertisement by TPG was considered to contravene the Australian Consumer laws. (para 3) The Statutory Provisions contravened by the company There are quite a few statutory provisions that is said to have been breached by the TPG Company. The company is said to contravene section 52 of the Trade Practices Act 1974 that provides that with regard to trade or commerce no company shall engage in misleading or deceptive conduct. (para 9) The company has further contravened Section 53 of the Trade Practices Act 1974 that provides that no corporation shall make any false representation relating to the price of goods or any conditions or warrantee or guarantee. (para 10) The findings of the Primary Judge Regarding the bundling condition the primary judge opined that the given condition in the advertisement should have been more clear and prominent to remove the deception. (para 23) He also stated that since the target audience was the first time users it was likely that they would rely on the dominant part of the advertisement and fall prey to the deception. (para 19) Regarding the set up fees the primary judge said the advertisements were not specified regarding the extra fees of the service. (para 26) For the single price the judge stated that according to section 53C (1) (c) of the TPA, the price was not clear. (para 28) The differences in principle between the approach of the Full Court and the approach of the primary judge The Full Court judgment was quite different from the primary judges decision. Contrary to the previous decision the Full Court held a different view for the dominant message in the advertisement. (para 30) The Court stated that the conduct which is under scrutiny has a lot of words and in accordance to their opinion it is wrong to select only some of the words and neglect the rest as they too give meaning to the prominent words. (para 35) Further the Court disagreed with the approach of the primary judge and opined that they were not misleading advertisements because by perfunctorily viewing the bundling conditions cannot be ignored. The Court also held that any ordinary prudent person would know that the services that have been offered would come as a package or bundle. (para 44) The High Courts opinion of the approach taken by the Full Court According to the High Court, the decision of the Full Court was wrong in holding the judgment of the primary court wrong. The High Court states that the dominant message is extremely crucial in this case. (para 52) According to the High Court the opinion of the CJ Gibbs in the case of Puxu as has been stated by the Full Court is not crucial and is surely cannot be properly applied to the conditions in the present case. The High Court opined that the Full Court was wrong in not appreciating the advertisement tendency being neutralized by attributing the knowledge of the court regarding the target audience about the ADSL2+ services that was offered in bundle. (para 47) Puxu was not a proper precedent to apply to the TPG advertising according to the High Court The case of Puxu was regarding the deceptive conduct depending on the sale of goods by the appellant which was indistinguishable from the ones sold by respondent. (para 46) The High Court refused to accept this precedent primarily because the target audiences were not the potential purchasers who focused on the subject matter of the purchase. (para 46) Additionally, the High Court also stated that the Full Court did not recognize the advertisement tendency was misleading when they asked about bringing in negotiation with TPG instead of one of the competitors relying on the general trust of the message. (para 48) The High Court also stated that primary issue in the case was not the tendency of the deception of the advertisements of the company as a result of the disposition of the target audience since that is not dependant on the conduct of the company in order to closely follow the advertisement wordings. (para 51) The approach of the High Court regarding the dominant message Regarding the dominant message the High Court opined that the main issue here was whether the fine print of the advertisement was sufficient to dismiss the question of dominant message that had been conveyed in the headline. Alternatively, the High Court opined that this question was associated with the probable customers of the internet services. The most important question as stated by the High Court was that whether the probable customers who were reading the advertisement with a clear mind would generally get an impression that the advertisement was separate broadband internet service for a separate price of $29.99 per month. The assumed level of knowledge in TPGs target audience Regarding the assumed level of knowledge related to the target audience the opinion of the High Court was the same as the approach given by the primary judge. The High Court opined that the users of ADSL2+ had more knowledge regarding the services of the TPG internet company than the ADSL1+ since they were knew to the services. (para 58) Advise based on the understanding of the High Court ruling After detailed understanding of the ruling of the High Court in this case, the probable advice that I would give to the internet provider about launching an advertising campaign would be that all the clauses relating to the services of the internet company should be prominent and there should be no bias relating to the important and less important clauses. Trinity and Cypher Paper Movies are wonderful things; they can inspire, spark debate, and even make you believe in what you are seeing. Virtual Reality is a creation of a highly interactive computer-based multimedia environment in which the user becomes a participant with the computer in a virtually real world. We do not know who they are at this point however, later it becomes clear that it was Trinity and Cypher on the phone, and that the phone was being tapped by the agents, who learn of Trinitys whereabouts and seek her out. The first character we visually see is Trinity, sitting at a computer, wearing a tight black latex cat suit, little does she know that there are policemen gathering outside the door to her hotel room. The police kick the door down and Trinity doesnt move. As one policeman advances to arrest Trinity, the action begins and we see Trinity as highly trained in the martial arts. The character is part of the Neo-Trinity-Morpheus group, and also part of the Neo-Trinity-Cypher love triangle. The name could also refer to the Christian Trinity (the Father, Son and Holy Spirit). You can tell that the Agents are the baddies instantly. They seem robotic, and powerful and very stereotypical, they wear black suits and dark sunglasses. Do they have something to hide? They walk and do things in unison with each other, this perhaps shows that they are robots and are controlled as a unit? Agent Smith is obviously the leader, as he gives out the commands; the other two agents that we see him with in the first scenes obey without question. All the agents wear earpieces and receive messages through these. Are they being told what to do by someone else? Or are they being told what to do by the Matrix? Agent Smith the name of the main Agent in the movie. Like Anderson, this is a generic sounding name, representing conformity, and the faceless nature of the Agents. Morpheus asks the agent who he is. The agent replies Agent Smith. Morpheus responds with You all look the same to me. Cypher is the unknown voice on the other end of the phone to Trinity right at the beginning of the Matrix. We dont know anything about Cypher until later on apart from the fact that he talks about killing someone and that he works with Trinity. We do not know his name until later on in the film, however the phone call conversation gets the viewers wondering what the film is about. One meaning for the word Cypher is zero. This is funny, because if Neo is the one (1), then that makes Cypher the zero (0). Together, Cypher and Neo are 0 and 1, the two digits in the binary number system used by computers. The two of them are opposing values in the movie, because they are working towards opposite ends. This number reference continues with Trinity as the 3. Therefore there also ought to be a character who is symbolically the 2, but who is it? Maybe it is Thomas Anderson, Neos name inside the Matrix. Thomas means twin. The whole movie is all about dual existence, in reality and in the Matrix. Another meaning of Cypher is a cryptographic system in which symbols are transposed or substituted. Symbolically, this name shows that Cypher is concealing something. Morpheus is first heard on the phone to Trinitys mobile. He sounds powerful and in control, he speaks calmly and slowly. He reassures Trinity and tells her to get out to the phone box outside, in which she can get out of the Matrix. The Matrix uses colour themes, where a single colour dominates many scenes in the movie. Some other movies Ive seen that use this visual technique are The Cook, the Thief, His Wife Her Lover, and Temptation of a Monk, to name just two. The three main colours (other than black) in the movie, in order of how often they occur are Green, Blue, and Red. The whole of the first scene is very dark, because it is set at night. The lighting gives a very tense, dangerous feeling and leaves the viewers on the edge of their seats. Spotlights are used a lot in the first scene, whilst following the policemen; the only lighting given off is from their torches. The viewers can only see what the policemen can see; therefore it makes them feel part of the action. In the real world, there is usually a blue tint on everything, whereas in the matrix, they use green tints. The green colour theme starts at the very beginning of the movie, and it is the most often used theme. The green-on-black theme may be a reference to old monochrome computer monitors, which often displayed green on a black background. The green inside the Matrix symbolises computers and artificial intelligence. It makes everything look quite creepy and unreal. The opening scene, which is very dark creates a sense of foreboding and uneasiness. I think you can say that RED would be the colour that represents sacrifice for freedom. (RED usually indicates blood, which is usually a requirement for freedom) Red pill = freedom Red woman = by longing for the woman in red Neo risks his freedom in taking a second look and almost getting shot by an Agent Red blood = end of the movie, when he bleeds and becomes freed from his mind and becomes The One Red pod = when he wakes up and sees the red stuff around him, he becomes freed from the enslavement of the Matrix. Sound is a major issue in The Matrix. There are many sounds in the first scene that set the mood of the film. Computer bleeps, keyboard tapping etc. Many of the sounds we hear are voices. The voices of Trinity and Cypher on the phone, and Morpheus cool and reassuring voice, when he talks to trinity on her mobile. There are also a whole range of sound effects and music. These are what I shall concentrate on. There are a lot of diegetic sounds in the first scenes of The Matrix. Gunshots, the sound of feet running, footsteps, the Agents car pulling up to the hotel etc. All of these sounds add to the realistic atmosphere of the film.

Anti-colonial, nationalist movements such as the Jewish terrorist organizations active in pre-independence Israel and the Muslim dominated FLN in Algeria come eagerly to mind, as do more topical examples such as the devastatingly Catholic IRA; their Protestant counterparts, arrayed in various loyalist paramilitary groups like the Ulster Freedom Fighters, the Ulster Volunteer Force and the Red Hand Commandos; and the predominantly Muslim PLO. Though, in all these groups it is the political, not the sacred aspect of their motivation that is prevailing; the primacy of their ethno-nationalist and/or irredentist aims is obviously true. For others, however, the religious motivation is overriding. Certainly, the religious crucial for terrorism are the most significant defining characteristic of terrorist activity today. The consequences of the rebellion that transformed Iran into an Islamic republic in 1979 have included its critical role in the renaissance of this strand of terrorism; but, the contemporary advent of religious terrorism has not been restricted exclusively to Iran, much less to the Middle East or to Islam: since eighties it has involved elements of all the worldsââ¬â¢ key religions and, in several instances, smaller sects or cults as well. I have no regrets, said Yigal Amir, the young Jewish extremist who assassinated Israeli Prime Minister Yitzhak Rabin, to the police. I acted alone and on orders from God. (Amir Yigal, 1987, pp. 7-8). Like Al-Qaeda, Hezbollah is another international terrorist group that was the product of numerous splits within the Lebanese Shia movement. Its origins can be traced back to 1974, when a Lebanese Shia cleric, Imam Musa al-Sadr, who had studied in the Iranian holy city of Qom, organized the Movement of the Underprivileged to advance Shia interests and progress the communitys lowly socioeconomic conditions. This movement was consequently reorganized as the principal Shia political party in Lebanon, Amal, which formed its own militia during the civil war that racked Lebanon a year later. Hezbollahs ideology is as simple as the organization is ââ¬Å"wraithlike. â⬠The members are taught that humans form two groups: the followers of Allah (Muslims) and the followers of Satan (infidels) who must be censored so that Allahs rule will expand to the whole planet. Satan, they have been told, evident himself in all sorts of disguises: a womans lock showing from under her veil (chador); the bare leg of a teenager boy; women and men mixing in public places (cinemas, cafes, restaurants); the Israeli profession of Palestine; and so on. The struggle against Satan is a full-time job for party members; the partys proposal clearly states: ââ¬Å"Our religion is not a meager part-time hobby like cross-worshipers who go to church on Sunday to bribe their God. â⬠(Robert Fisk, 1996) The party recruit ââ¬Å"volunteers for martyrdom,â⬠trains them, and flings them on missions. In October 1983, such volunteers carried out the suicide bombing of the American marines and French commandos in Beirut. Other members linger the streets, throwing acid on womens unveiled faces, pasting opponents, setting fire to newspaper offices, and so on. The party also broadcasts courses on radio and TV on how to use a diverse firearm, techniques of guerrilla warfare, kidnapping, assassinations of ââ¬Å"enemies of God,â⬠and other deeds. The size of the membership is composed of teenagers and even children. Throughout the eight-year war with Iraq, ââ¬Å"childrenââ¬â¢s martyrsâ⬠were commonly sent to the mine fields to clear the way for tanks. A senior member of the party explained that children can be replaced at less cost than the tanks. Khomeinis justification was perceptibly less cynical: Those less than twenty have not yet been infected by satanic Western culture. In its first months, the Islamic Republic used Syrian and Palestinian terrorists to perform assassinations of opponents in foreign countries. In 1980, Khomeini ordered the formation of an Iranian force capable of striking anywhere in the world. Hojatol-Islam Fazlollah Mahalati, with the assistance of Hadi Ghaffary and Chamran, a pro-Khomeini radical who lived in Lebanon (who had both been trained in PLO camps in the early 1970s), was dispersed to the task. By 1981 the hit squads started their worldwide operations. In 1979, however, al-Sadr vanished throughout a visit to Libya. The desertion of the Imam created a vacuum within Amal that made the party productive ground for Iranian influence, and given the movement prone to the fundamentalist call of the revolt which had brought Khomeini to power earlier that year. Nabih Berri, a lawyer, was appointed head of Amal the following year. Hussein Mussawi, and the assumed mastermind behind the terrorist campaign against Libya to recover the Imam, was named as Berris deputy and commander of the militia. A fanatical supporter of Khomeini, Mussawi sought to place Amal in the front line of a regional revolution based on the new Iranian Islamic Republic. Berri, on the other hand, clung to a modest line and advocated a new deal for the Shia community within the limits of the existing Lebanese state structure. By this time, though, the radicalization of the Shia in Lebanon had gone far away the narrow nationalist and social aims of Amal. In 1981, Mussawi broke with Berri and founded his own organization, Islamic Amal. Shortly after, another faction split from Amal and under the leadership of Abbas Mussawi and the spiritual guidance of Sheikh Mohamed Hussein Fadlallah, it soon came to be recognized as the Hezbollah. Like Islamic Amal, Hezbollah embraced Khomeinis directive for a pan-Islamic revolt designed to turn Lebanon into an Iranian-style Islamic republic. It is really unfortunate that people around the world are irritable about three human deaths throughout this war yet hardly uttered a word with the massacres lately in Africa where hundreds of thousands of people were murdered. The United Nations is calling for a cease-fire and saying this could lead to a humanitarian crisis. Though, this effort didnââ¬â¢t work well so far. According to Gal Luft, In Hizballahland, the movements fighters have much more than a safe haven. Its training camps have become a hub of international terrorism, a convention center for some of the worlds most dangerous men. Here they can experiment with new weapons, practice their tactics, and collaborate with fellow terrorists from groups like al Qaeda, Hamas, Ansar al-Islam, Palestinian Islamic Jihad, and the Kurdish Workers Party. From Lebanon, similarly, Hizballahs agents and associates can easily export their skills to destinations around the world. (Gal Luft, Hizballahland, Commentary Magazine, July-August 2003). The second advantage Hizballah enjoys is sophisticated weaponry. Al Qaedas arsenal is now limited to small, easily smuggle arms. When it comes to anti-aircraft capabilities, it possesses (as far as we know) only antiquated Soviet SA-7 Strella missiles, part of roughly 50,000 that were sold to third-world countries during the cold war; such missilesthey may have figured in last Novembers attack on an Israeli passenger plane in Kenyaare largely ineffective against the countermeasure routinely employed by modern planes. By contrast, Hizballah has accumulated an impressive stockpile of weapons, including, as I mentioned at the outset, thousands of rockets, artillery pieces, and antitank and anti-aircraft missiles. In the latter category, it has reportedly equipped itself with SA-18 missiles, whose substantially improved range and speed enable them to shoot down almost any aircraft. It played a key role in the January 2002 attempt to smuggle 50 tons of weapons to the Palestinian Authority aboard the Karine-A. Its external-operations commander, Imad Mughniyeh, one of the worlds most wanted terrorists, arranged to purchase the ship, and Mughniyehs deputy Haj Bassem personally supervised the loading operation at the Iranian island of Kish.
